Three dates matter for anyone filing or arbitrating federal IDR disputes this winter.
November 1. For batched disputes with an open negotiation start date on or after November 1, a batch can have no more than 50 line items. After a payment determination on one of those batches, the cooling-off period is 30 business days, not 90 calendar days. The web form will reject a new filing that comes in before the cooling-off period ends or more than 4 business days after. Single and bundled disputes stay on the 90-day clock. CMS indicates that payment determination letters will calculate the cooling-off dates by dispute type.
November 13. The four main IDR web forms (Initiation, Initiation Response, IDRE Selection and Notice of Offer) move into the IDR Gateway, with dashboards and dispute records.
January 15, 2027. The old single-use web forms go away, except the resubmission form.
One thing the new checks do not fix: the forms test dates, not whether the parties are really the same. Whether it is the same plan can turn on how the plan is funded, and the forms do not yet require the information needed to decide that (group number, plan funding status, TIN), so submit it for the IDRE's review.
Meanwhile, Congress is weighing very different fixes, from ending IDR for care after 2027 (H.R. 10788) to penalties for unpaid awards (H.R. 4710).
